Florida Expungement Ineligibility
When you apply for an expungement or a sealing, knowing whether your particular case qualifies or not is the first part of the process. You need to know the offenses which will exclude you from this undertaking. You do not qualify for a sealing or expungement if:
- You have been adjudicated guilty of a criminal offense or comparable ordinance violation or adjudicated delinquent for committing a felony or a misdemeanor.
- The criminal history reflects that you have been adjudicated guilty of or adjudicated delinquent for committing one or more of the acts stemming from the arrest or alleged criminal activity to which the application pertains
- Your criminal history record reflects that you have received a prior sealing or expunction of a criminal history record under Florida Statute 943.0585, 943.059, or from any other jurisdiction.
There are certain circumstances in which you can not receive a sealing or an expungement.

Florida law lists the offenses which you can not appeal to the court for a change in your criminal record:

- Procuring a person under age of 18 for prostitution (796.03)
- Lewd or lascivious (800.04)
- Voyeurism (810.14)
- Acts of Fraud (817.34)
- Lewd and lascivious acts committed on or in the presence of an elderly person (817.34)
- Abuse of Children (827.071)
- Obscenity (847.0133)
- Computer pornography; traveling to meet a minor (847.0135)
- Mentally Deficient and Mentally ill Defendants (916.1075)
- A violation enumerated in (907.041)
- Offenses that Requires Sexual Predator Registration (907.041)
- Offenses that Requires Sexual Offender Registration (943.0435)
