Florida Expungement Ineligibility

When you apply for an expungement or a sealing, knowing whether your particular case qualifies or not is the first part of the process. You need to know the offenses which will exclude you from this undertaking. You do not qualify for a sealing or expungement if:

  1. You have been adjudicated guilty of a criminal offense or comparable ordinance violation or adjudicated delinquent for committing a felony or a misdemeanor.
  2. The criminal history reflects that you have been adjudicated guilty of or adjudicated delinquent for committing one or more of the acts stemming from the arrest or alleged criminal activity to which the application pertains
  3. Your criminal history record reflects that you have received a prior sealing or expunction of a criminal history record under Florida Statute 943.0585, 943.059, or from any other jurisdiction.
